1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Vistagram ("Company," "we," "us," or "our") governing your access to and use of the Vistagram mobile application, website, and all related services (collectively, the "Service").

By downloading, installing, or using the Vistagram app, or by accessing our website at vistagram.app, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

To use Vistagram, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater).
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the Service under applicable laws.
• Provide accurate and complete information when registering your account.

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

3.1 Account Creation

To access most features of Vistagram, you must register for an account by providing your phone number. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your account credentials secure and confidential.
• Notify us immediately of any unauthorized use of your account.

3.2 Account Responsibility

You are solely responsible for all activity that occurs under your account. Vistagram is not liable for any loss or damage arising from your failure to maintain the security of your account.

3.3 One Account Per User

Each person may maintain only one Vistagram account. Creating multiple accounts or accounts on behalf of others without authorization is prohibited.

4. Use of the Service

Vistagram grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal and professional photography-related purposes, subject to these Terms.

You agree to use the Service only for its intended purposes, which include:

• Creating and managing your professional photographer studio profile.
• Joining and creating photographer groups for networking and collaboration.
• Posting and responding to hire requests for photography events.
• Participating in deal negotiations and approvals.
• Accessing photography-related educational content.

5. Photographer Groups

5.1 Group Creation

As a Vistagram user, you may create photographer groups. By creating a group, you take responsibility for:

• Managing the group and its members appropriately.
• Ensuring group activity complies with these Terms.
• Moderating content shared within your group.

5.2 Group Participation

When participating in groups, you agree not to share content that is unlawful, harmful, harassing, or otherwise objectionable. Vistagram reserves the right to remove any content or users that violate these Terms.

6. Hire Posts & Deal System

6.1 Hire Posts

When creating hire posts, you must:

• Provide accurate information about the event, requirements, and compensation.
• Only post genuine opportunities for collaboration.
• Not post misleading, fraudulent, or spam hire requests.

6.2 Deal Acceptance & Approval

The deal and approval system facilitates connections between event owners and photographers. Vistagram acts solely as a platform and is not a party to any agreement made between users. Users are responsible for:

• Any agreements or arrangements made through the platform.
• Fulfilling commitments made when accepting or approving deals.
• Resolving any disputes that arise from collaborations arranged through Vistagram.

6.3 No Guarantee

Vistagram does not guarantee that any hire post will receive responses, that deals will be completed, or that collaborations will be successful. We provide the platform infrastructure; the outcomes depend on the parties involved.

7. Content & Intellectual Property

7.1 Your Content

By submitting content (photos, studio information, posts, etc.) to Vistagram, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content solely for the purpose of providing and improving the Service.

You retain ownership of all content you submit. You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party rights.

7.2 Vistagram's Intellectual Property

The Vistagram name, logo, app design, and all related trademarks and intellectual property are owned by Vistagram. You may not use our intellectual property without prior written consent.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Harass, abuse, threaten, or harm other users.
• Post false, misleading, or fraudulent information.
• Impersonate any person or entity.
• Attempt to gain unauthorized access to any part of the Service or other users' accounts.
• Use automated tools (bots, scrapers) to access or collect data from the Service.
• Interfere with the proper functioning of the Service.
• Create multiple accounts to circumvent restrictions or bans.
• Use the platform for spam, unsolicited messages, or commercial advertising without authorization.
• Share content that infringes copyrights, trademarks, or other intellectual property rights.

9. Disclaimers & Limitation of Liability

9.1 Service Provided "As Is"

Vistagram is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9.2 Limitation of Liability

To the fullest extent permitted by applicable law, Vistagram shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you have paid to Vistagram in the twelve months preceding the claim (or ₹500 if you have not made any payments).

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, the Service, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

We encourage you to contact us directly to resolve any disputes before pursuing formal legal action.
